Terms of Service

These Terms of Service ("Terms") govern your access to and use of WinAds Pro (the "Service"), an AI ad-strategy tool operated independently from India ("WinAds Pro", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

WinAds Pro generates AI-assisted advertising strategy briefs — including a diagnosis, buyer avatars, angles, ranked hooks, example ad scripts, and examples of real ads currently running in your market (sourced from public ad libraries such as the Meta Ad Library and TikTok Creative Center). All outputs are AI-generated suggestions for informational purposes. They are not advice, guarantees, or predictions of advertising performance, revenue, or results.

2. Eligibility & accounts

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• You are responsible for all activity under your account.

3. Acceptable use

You agree not to:

• Resell, redistribute, or sublicense the Service or its outputs as your own product;
• Scrape, reverse-engineer, or attempt to extract our prompts, source code, or underlying data;
• Use the Service to create content that is unlawful, deceptive, infringing, or that violates the advertising policies of Meta, TikTok, Google, or any other platform;
• Overload, disrupt, or attempt to gain unauthorized access to the Service.

4. Plans, billing & our payment processor

WinAds Pro offers a free plan and paid subscription plans (Pro and Agency). Paid plans are billed on a recurring monthly basis and renew automatically until cancelled.

Payments are processed by Lemon Squeezy, our merchant of record. When you purchase a subscription, Lemon Squeezy — not WinAds Pro — is the seller of record for that transaction. Lemon Squeezy handles payment processing, billing, and the collection and remittance of applicable sales tax/VAT/GST, and will appear on your card or bank statement. Your use of Lemon Squeezy's checkout is also subject to Lemon Squeezy's own terms and privacy policy. We do not receive or store your full card details.

You can view invoices, update payment methods, or cancel your subscription at any time through the customer portal (the "Manage billing" link in your dashboard). Cancellation and refund details are described in our Refund & Cancellation Policy.

5. Credits & fair use

The free plan includes a limited number of strategy generations. Paid plans are offered as "unlimited" subject to fair, reasonable, and non-abusive use; we may apply reasonable rate limits or contact you if usage appears automated or abusive.

6. Intellectual property

• We own the Service, including its software, design, and prompts.
• You retain ownership of the product information and images you submit. You grant us a limited license to process them to generate your briefs.
• Subject to these Terms and payment of applicable fees, you may use the strategy briefs we generate for your own business.
• Examples of third-party ads are drawn from public ad libraries and remain the property of their respective owners; they are shown for research and educational reference only.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee any advertising result, sales, return on ad spend, or business outcome. You are solely responsible for the ads you run, your spend, and your compliance with the policies and laws that apply to your advertising. Ad-library data is provided by third parties and may be incomplete or inaccurate.

8. Limitation of liability

To the maximum extent permitted by law, WinAds Pro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or ad spend. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.

9. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. IP, disclaimers, liability) will survive.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts located in India will have exclusive jurisdiction, except where applicable consumer law provides otherwise.
